Clause 70.2

Title to Plant and Materials

Purpose

Title passes to the Employer when the Contractor is paid for them, or when they are brought on Site.

Practical Application

Title transfer protects the Employer if the Contractor becomes insolvent. Mark items clearly as Employer's property.

Common Pitfalls

If title passes on payment, ensure the Contractor can identify which items have been paid for.
