Clause X15

Limitation of Liability

Purpose

The Contractor's liability is limited to the amount stated in the Contract Data.

Practical Application

The limitation applies to all liability under the contract. It does not apply to death or personal injury.

Common Pitfalls

The limitation amount must be realistic. An unrealistically low limit may be challenged as not reflecting the parties' intent.
