Neither party assigns the contract or any part of it without the other party's written consent. The Employer may assign the benefit of subcontracts to a funder.
Assignment restrictions protect both parties. The Employer may need to assign to its funder or purchaser. The Contractor may need to assign to a parent company or successor.
Assignment without consent is ineffective. If the Employer requires assignment to a funder, this should be addressed in the Contract Data or a side agreement.
