Identification & Notification
9.1 What is a Compensation Event?
A compensation event (CE) is any event listed in Clause 60.1 that entitles the Contractor to a change in the Prices, the Completion Date, or both. Unlike traditional contracts, NEC4 does not distinguish between variations, change, and breach — they are all compensation events.
9.2 Notification Timelines
The Contractor must notify the Project Manager of a CE within 8 weeks of becoming aware of the event (Clause 61.3). Failure to notify within this period means the Contractor loses entitlement unless the PM has not proceeded with the assessment. This is an absolute time bar — no discretion.
Key Trap: The 8-week clock starts when the Contractor should reasonably have become aware, not when formal notice is prepared. Many contractors lose entitlement by delaying notification.
