Clause 91.1

Adjudicator Appointment

Purpose

The Adjudicator is named in the Contract Data or appointed by a nominating body.

Practical Application

If the named Adjudicator is unavailable, either party may ask the nominating body to appoint a replacement.

Common Pitfalls

If no Adjudicator is named and a dispute arises, delay in appointment can affect programme. Name one pre-contract.
