Third Party Rights

Purpose

The Employer's funders, purchasers, and tenants have the benefit of the contract. The Contract Data specifies which clauses benefit which third parties.

Practical Application

Third party rights under the Contracts (Rights of Third Parties) Act allow specified third parties to enforce contract terms directly against the Contractor.

Common Pitfalls

The scope of third party rights should be carefully defined. Broad third party rights expose the Contractor to claims from multiple parties who were not party to the contract.
