Collateral Warranty

Purpose

The Contractor provides collateral warranties to the Employer's funders, purchasers, or tenants. The form and beneficiaries are stated in the Contract Data.

Practical Application

Collateral warranties give third parties direct contractual rights against the Contractor. The Contractor provides the warranties before or at Completion.

Common Pitfalls

Warranties may impose liability beyond the contract, particularly in scope and duration. Review warranty terms carefully and ensure they align with the contract liabilities.
