Clause 17.2

Illegal or Impossible Requirements

Purpose

The Project Manager or the Contractor notifies the other as soon as either becomes aware that the Scope includes an illegal or impossible requirement. If it does, the PM gives an instruction to change the Scope appropriately.

Practical Application

Either party must immediately report any requirement in the Scope that is illegal or physically impossible to achieve. The PM then issues a change instruction, assessed as a compensation event.

Common Pitfalls

The bar for impossibility is high. Merely difficult, expensive, or impractical does not qualify. The Contractor must demonstrate that no lawful method of compliance exists.
