Services and Things to be Provided
The Client and the Contractor provide services and other things as stated in the Scope. Any cost incurred by the Client as a result of the Contractor not providing the services and things which it is to provide is assessed by the Project Manager and paid by the Contractor.
The Scope should clearly list what each party is to provide. The Contractor bears the cost if its failure to provide agreed services or things causes the Client additional expense.
If the Scope is ambiguous about which party provides what, disputes arise over cost recovery. The Contractor should clarify scope gaps at tender stage and confirm in writing before proceeding.
