Other Responsibilities — Care of the Works

Purpose

The Contractor takes care of the works and Equipment until the Defects Certificate is issued. The Contractor is liable for loss or damage to the works except to the extent caused by an Employer's risk.

Practical Application

The Contractor bears the risk of physical loss or damage to the works during construction. This risk transfers to the Employer at the Defects Certificate.

Common Pitfalls

Insurance for the works must cover the Contractor's care obligation. Employer's risks (clause 80.1) are excluded from the Contractor's care obligation.
