Clause 35.4

Completion — Deferment

Purpose

The Employer may defer the starting date or access to parts of the Site. The period of deferment is stated in the Contract Data.

Practical Application

Deferment allows the Employer to delay the project start for funding, approvals, or other reasons. The maximum deferment period is typically stated in the Contract Data.

Common Pitfalls

Deferment beyond the stated period is a CE. The Contractor is entitled to additional time and cost for extended deferment.
