Defects — Late Correction
If the Contractor corrects a defect after the defect correction period has ended but before the Employer corrects it, the Employer may still recover the costs of arranging the correction.
Late correction by the Contractor does not automatically avoid cost recovery by the Employer. The Employer's reasonable costs of administration and supervision of the correction are recoverable.
If the Employer has already contracted with a third party to correct the defect, the Contractor's late correction may not cancel the Employer's contractual obligations to that third party.
