Clause 50.9

Finalisation of Defined Cost

Purpose

The Contractor notifies the PM when Defined Cost for a part of the works has been finalised, making records available for inspection. The PM reviews within 13 weeks. If further records are needed or errors found, the Contractor has 4 weeks to respond. If the PM does not notify a decision within the stated time, the Contractor's assessment is treated as correct.

Practical Application

This structured process finalises Defined Cost in parts. The Contractor triggers the process by notification and record provision. The PM has defined review periods. If the PM misses a deadline, the Contractor's assessment stands.

Common Pitfalls

The Contractor must make all supporting records available. Inadequate records give the PM grounds to request more information, extending the process. Poor record-keeping can delay finalisation indefinitely.
