CE — Access Delay
The Employer does not give access to a part of the Site by the date shown on the Accepted Programme. The Contractor is entitled to time and cost for the delayed access.
The Accepted Programme is the reference for timing of access. If the Employer fails to make a part of the Site available as planned, it is a CE.
The access date must be shown on the Accepted Programme. If the programme does not specify access dates for specific areas, the Contractor may struggle to prove entitlement.
