Clause 34.1

Access to the Works

Purpose

The Employer provides access to each part of the Site needed by the Contractor to Provide the Works. Access is provided by the date stated in the Contract Data or the Accepted Programme.

Practical Application

The Employer must make each part of the Site available in accordance with the programme. If access is delayed, the Contractor notifies a CE.

Common Pitfalls

Partial access or restricted access may still constitute a delay if it prevents the Contractor from working as planned. The Works Information should specify access constraints clearly.
