Section 6Compensation Events

Clause 60.6

CE Notification — Time Bar

Purpose

If the Contractor does not notify a CE within eight weeks of becoming aware of the event, the Contractor is not entitled to a change in the Prices or Completion Date.

Practical Application

This is a strict time bar. The period runs from the date the Contractor became aware (or should reasonably have become aware) of the event, not from when full impacts are known.

Common Pitfalls

The eight-week time bar is absolute. There is no discretion to extend it. The only exception is if the PM notified the CE first under 61.1.
