Title to Plant and Materials
Title to Plant and Materials passes to the Employer when the Contractor is paid for them or when they are brought on to the Site, whichever is earlier.
Title transfer protects the Employer's interest in materials stored on Site or in transit. The Contractor clearly identifies Employer-owned items.
If materials are stored off-Site, title may not pass until payment. The Contractor should have a separate vesting agreement for off-Site materials if required.
