Termination — Reasons
The Employer may terminate the contract for the reasons stated in clause 93.1. The Contractor may terminate if the PM does not certify payment or the Employer does not pay.
Termination is a serious step. The grounds are limited and must be strictly complied with. The terminating party certifies the grounds in the termination notice.
Wrongful termination is a repudiatory breach. The terminating party must be certain the grounds exist and the procedure is correctly followed before issuing notice.
