Clause 90.3

Termination — Procedure

Purpose

The terminating party notifies the other party and the PM of the termination. The notification states the reason. The PM certifies whether the grounds exist.

Practical Application

The termination process begins with a notice. The PM then certifies whether the stated grounds are valid. The termination takes effect on the date stated in the notice.

Common Pitfalls

The certification by the PM is not final — it can be challenged through adjudication. The Contractor should seek legal advice immediately upon receiving a termination notice.
