Section 1General

Clause 13.7

Separate Communication of Notifications

Purpose

A notification or certificate which the contract requires is communicated separately from other communications. Notifications and certificates are not combined with general correspondence.

Practical Application

Key communications such as compensation event notifications, early warnings, and defect notifications must be sent as standalone communications, not buried in progress reports or meeting minutes.

Common Pitfalls

Including a notification within a general communication may not satisfy the separate communication requirement. Always send formal notifications as distinct, clearly titled messages.
