Retention for Missing Programme
If no programme is identified in the Contract Data, one quarter of the Price for Work Done to Date is retained in assessments of the amount due until the Contractor has submitted a first programme to the PM for acceptance showing the information which the contract requires.
This provision penalises the Contractor for not having an Accepted Programme. 25% of the Price for Work Done to Date is withheld until a compliant programme is submitted and accepted.
The retention applies from the first assessment if no programme was identified in the Contract Data. The Contractor should prioritise programme submission to release the retained amount.
