Clause 60.1(17)

CE — Failure to Notify

Purpose

The PM does not notify the Contractor of a CE within one week of becoming aware of it. The Contractor may still claim the CE.

Practical Application

This CE protects the Contractor when the PM fails in their duty to notify CEs. The Contractor can still pursue the CE under 61.3.

Common Pitfalls

This is not an independent CE — it preserves the Contractor's right to claim. The Contractor should still notify under 61.3 to protect its position.
