Joint Names and Cover Period
The insurances in the Insurance Table are in the joint names of the Parties except the fourth insurance stated. The insurances provide cover for events which are the Contractor's liability from the starting date until the Defects Certificate or a termination certificate has been issued.
Joint insurance prevents the insurer from subrogating against either Party. Cover runs from project start through to the Defects Certificate. The fourth insurance (employer's liability) is an exception and is in the Contractor's name only.
The Contractor must ensure policies are actually issued in joint names where required. A policy in the Contractor's name only may leave the Client unprotected and in breach of the contract.
