Termination — Extended Stop Instruction (R18, R19, R20)
If the PM has instructed the Contractor to stop or not start substantial work and no further instruction has been given within 13 weeks, the Client may terminate if the instruction was due to Contractor default (R18), the Contractor may terminate if due to Client default (R19), or either Party may terminate for any other reason (R20).
A stop-work instruction lasting 13+ weeks triggers termination rights. The specific ground depends on who caused the suspension. The right belongs to the non-defaulting Party or either if no default.
The 13-week period runs from the stop instruction date. The PM may issue a work-removal instruction within 13 weeks to avoid triggering termination rights under this clause.
