Termination Procedures P2, P3, P4
On termination, the Client may instruct the Contractor to leave the Site and remove Equipment and assign subcontract benefits (P2); use any Contractor-owned Equipment to complete the works (P3); or the Contractor leaves the Working Areas and removes Equipment (P4). Which procedures apply depends on the termination reason.
The Termination Table specifies which procedures apply for each reason. P2 gives the Client maximum control over post-termination completion. P3 allows use of Contractor's equipment.
Under P3, the Contractor bears the risk of damage while the Client uses its equipment. The Contractor should ensure equipment remains insured during the Client's use period.
